Contract for Mentorship: The Happy Medium Approach
This contract describes the relationship between Eclipse Therapy, LLC, Mentor, and Individual Name, client acquiring Mentorship post eligibility requirement for a BACB credential. This mentor and client DO NOT work in the same service-delivery environment.
This Mentorship agreement is made on the date of signed below between Eclipse Therapy, LLC (mentor) and Individual Name (client) for mentorship related to the delivery of applied behavior analysis services.
Appropriate activities may include the following; the mentor will discuss with the client which additional activities qualify. Activities covered in behavior analytic supervision including Observation and data collection • Training staff and caregivers on behavior-analytic programs or content • Conducting assessments related to the need for behavioral intervention • Meeting with clients about behavior-analytic programming and services • Conducting behavior-analytic assessments (e.g., functional analyses, stimulus preference assessments) • Data graphing and analysis • Researching the literature relevant to a current client’s programming • Writing and revising behavior-analytic programs
Instructional objectives will be determined by the mentor and client related to the client’s place of service delivery and could include the following:
- Review and conduct assessment activities
- Discuss or supervise individualized planning and documentation based on assessment activities, best practices, and literature applicable to the client
- Monitor, design, or implement behavior analysis programs (training, skill acquisition, skill reduction, education to improve effectiveness) for clients, self, and others as applicable
- Evaluate programs for effectiveness, collect, analyze and display data, and discuss progress in behavior analytic terms; communicate about results with stakeholders and supervisor and make modifications to programs based on data
RESPONSIBILITIES AND AGREEMENTS
- The mentor is also a supervisor in good standing with the Behavior Analysis Certification Board and has completed the 8-hour supervision training
- Mentor and client agree to work together to facilitate in-depth discussion/understanding of issues affecting practice – both personally and professionally – and developing a high level of behavior-analytic expertise.
- Mentor agrees to provide specific feedback to the client on performance; this may be conducted via web-camera, videotape, videoconferencing, or similar means in lieu of the supervisor being physically present.
- Both parties agree to protect the time and space for mentorship, by keeping to agreed appointments and the time allotted. Privacy will be respected and interruptions avoided. Any party requiring a variance in the schedule will notify the other party at the earliest possible time of variance to determine an appropriate time to reschedule.
- The client will keep track of hours
- Invoices will be provided to the client at least monthly, billed at the rate of $85/hour for services provided. Remuneration will be accepted at the billing address in this contract.
- In addition to mentorship meetings, the client must adhere to job requirements related to attendance at additional professional meetings relevant to cases
- Mentor agrees to accept no remuneration from client above the negotiated hourly consultant rate.
- The mentor and client both agree to maintain a copy of each signed document including all required forms identified in this document, and this signed contract. Both parties agree to keep this documentation for 7 years.
- During the mentorship, there will be progress reviews conducted after every 6 months. At these reviews, the mentor will provide feedback to the client and discuss and document the progress being made and client satisfaction. After two progress reviews during which inadequate progress has been made, the mentor must determine whether the relationship should continue, and provide in writing the required steps to allow for continued mentorship. If the determination is made that the mentorship relationship should end, the mentor must provide in writing to the client what areas were lacking adequate progress so that the client may continue to grow.
- The following circumstances would justify a mentor pausing or stopping the mentorship relationship
- The client receives 4 or more unsatisfactory performance evaluations.
- Egregious violation of the BACB’s Guidelines for Responsible Conduct for Behavior Analysts and/or behavior that jeopardizes the well-being of clients or other team members.
- Client fails to attend meetings or plan in advance for cancellations; maintains adequate and timely documentation of reports, or violates code of ethics.
- The client agrees to the video recording of the client implementing behavior analysis duties, if appropriate.

RESPONSIBLE CONDUCT
- Both mentor and client, herein referred to as “both parties” agree to adhere to high standards of professional behavior. This includes behavioral discussions grounded in scientific and professionally derived knowledge.
- The mentor will provide mentorship to the client only within the boundaries of his/her competence.
- Both parties agree to maintain confidentiality in accordance with the guidelines for responsible conduct and all pertinent legal regulations.
- Both parties have read, understood, and will adhere to the BACB’s Ethical and Professional Compliance Code for Responsible Conduct for Behavior Analysts. Particular attention will be given to sections related to conduct, responsibility to clients, and assessing behavior.
CONFIDENTIALITY
Confidential Information. On and after the date of this agreement, mentor and client shall keep confidential all information relating to current or potential clients including, but not limited to, any medical or clinical information, in whatever form. Mentor and client shall be jointly responsible for ensuring that other clients have consented to the observation of service delivery and sharing of confidential client information if this becomes relevant.
Mentor Records. All records related to the activities described in this contract are and shall remain the property of Eclipse Therapy, LLC Client shall not, except in the ordinary and usual course of their duties and obligations under this agreement, remove from mentor’s premises, copy, or retain any of Eclipse Therapy, LLC records. Upon termination of the agreement, the client agrees to return promptly to Eclipse Therapy, LLC any of Eclipse Therapy, LLC records, copies of records, and all other property that is in client’s possession or under their control or custody.
TERM AND TERMINATION
Term. This agreement shall be effective on May 30th, 2022 (date) and shall remain in effect until either party terminates this agreement by 30 day’s advance written notice to the other of the intention to terminate. In the event of termination Clause, 14 shall survive and remain valid.
MISCELLANEOUS PROVISIONS
Entire agreement. This agreement contains the entire agreement between the Parties hereto with respect to the subject matter hereof.

Modifications – Modifications may be requested to this agreement in writing and sent to Eclipse Therapy, LLC, 2091 Kerr Gulch Rd, Evergreen, CO 80439
Severability – If one clause is stricken by implication of law, the remaining clauses of the contract will still be considered valid.
Notice under this agreement by one Party to another Party shall be in writing and considered effectively given if personally delivered or deposited via postal service, postage prepaid, certified or registered, return request, and addressed to the recipient as follows:

The responsibilities described in this document will be carried out in accordance with the BACB’s Guidelines for Responsible Conduct for Behavior Analysts and Professional Disciplinary and Ethical Standards.
